New Trade Union Provisions: What HR Teams Need to Know

Know what's changing, and how to stay ahead of it.

The Employment Rights Act 2025 is changing how trade unions operate in the workplace, and some of those changes are landing this month. If you’re in HR or payroll, now’s the time to get your processes ready.

This session will walk you through what’s changing, what it means day-to-day, and what you can start doing now to stay compliant.

What we’ll cover:

  • Electronic balloting: from August 2026, union members can vote electronically or in person for industrial action, union elections, and other statutory ballots, as long as the employer and union agree to it. We’ll explain what this means for your organisation in practice.
  • What’s next: the 50% turnout threshold for industrial action ballots is expected to be removed once electronic balloting is in place. We’ll cover the likely timing and what to watch for.
  • Recognition rules: from April 2026, trade union recognition rules were simplified, and unions no longer need to show they’re likely to win a ballot when applying to the Central Arbitration Committee. We’ll look at how this fits into the wider picture.
  • Getting ahead of October: employers will have a new duty to inform staff of their right to join a trade union, alongside stronger rights around workplace access and paid time off for union reps. We’ll help you start preparing early.
